ORDER

This writ petition has been filed to direct the respondent to consider the petitioner's representation dated 19.06.2024.

2. The learned counsel for the petitioner would submit that in this case, a representation was filed by the petitioner to conduct an enquiry into the petitioner's grievances. However, the said representation was not at all considered by the respondent till date. Hence, this petition.

The learned counsel appearing for the respondent would submit that the petitioner had already approached the respondent and subsequently, filed a writ petition in WP.No.14469 of 2011 for the very same relief. The said writ petition was dismissed vide order dated 16.07.2019 on the ground of pendency of Civil proceedings. Against the said order, a writ appeal in WA.No.383 of 2014 was filed by the very same petitioner and the same was dismissed vide order dated 01.08.2014. Aggrieved over the said dismissal order, a review application in Rev.Appln.No.214 of 2025 was filed and the same was allowed vide order dated 14.10.2025, whereby a direction was issued to the 2nd respondent therein to conduct an inquiry and pass appropriate orders.

4. Further, he would contend that the relief sought for by the petitioner in this petition was already granted by this Court vide order dated 14.10.2025 passed in Rev.Appln.No.214 of 2025. In such case, he would submit that no further order is required in the present petition and thus, prays for dismissal of this petition.

5. Heard the learned counsel for the petitioner and the respondents and also perused the entire materials available on record.

6. In the case on hand, the petitioner had already approached the respondent and subsequently, filed a writ petition in WP.No.14469 of 2011 for the very same relief. The said writ petition was dismissed vide order dated 16.07.2019 on the ground of pendency of Civil proceedings. Against the said order, a writ appeal in WA.No.383 of 2014 was filed by the very same petitioner and the same was dismissed vide order dated 01.08.2014. Aggrieved over the said dismissal order, a review application in Rev.Appln.No.214 of 2025 was filed and the same was allowed vide order dated 14.10.2025, whereby a direction was issued to the 2nd respondent therein to conduct an inquiry and pass appropriate orders.

7. For ready reference, the relevant portion of the order dated 14.10.2025 is extracted hereunder:

"8. In view of the above factum, the order passed on 01.08.2014 in W.A.No.383 of 2014 is reviewed. Consequently the 2 nd respondent / Commissioner of Land Administration is directed to conduct an inquiry into the matter based on the documents and evidences available on record, including the report of the District Level Committee dated 31.05.2011 and pass appropriate orders on merits and initiate all appropriate actions in the manner known to law. The said exercise is directed

to be completed within a period of six (6) months from the date of receipt of a copy of this order."

8. A perusal of the above order makes it clear that the relief sought for by the petitioner was already granted vide the said order. Therefore, as rightly contended by the respondents, there is no necessity to pass any further orders in this writ petition.

9. In view of the above, this Court is inclined to dismiss the present petition. If the order dated 14.10.2025, passed by the Hon'ble Division Bench of this Court in Rev.Apln.No.214 of 2025, is not complied with by the respondents, it is up to the petitioner to report the same before the concerned Court by way of filing a Contempt Petition.
