ORDER

This Criminal Miscellaneous Petition has been filed by the complainant/respondent in Crl.RC.No.189 of 2023 to direct the learned Metropolitan Magistrate Fast Track Court2, Egmore at Allikulam, Chennai to make payment of Rs.5,00,000/- deposited by the accused in C.C.No.3814 of 2016 in compliance to the order in Crl.M.P.No.16566 of 2022 in Crl.A.No.401 of 2019 on the file of the VII Additional City Civil and Session Judge, Chennai, by issuing a cheque in favour of the petitioner.

2. Heard the learned counsel for the petitioner and perused the materials available on record.

3. The learned counsel for the revision petitioner/respondent herein seeks time.

4. Since the revision petitioner is not ready to proceed with the revision, this Criminal Miscellaneous Petition is ordered.

5. Accordingly, the Metropolitan Magistrate Fast Track Court-2, Egmore at Allikulam, Chennai, is directed to permit the petitioner/respondent in Crl.RC.No.189 of 2023 to withdraw the said amount of Rs.5,00,000/- (Rupees Five Lakhs Only) deposited by the accused in C.C.No.3814 of 2016, after obtaining appropriate undertaking that in case the revision petitioner succeeds, the petitioner/respondent in Crl.RC.No.189 of 2023 has to re-deposit the said amount before the Court.
