ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 4(1)(c), 4(1-A) (ii) of Tamilnadu Prohibition Act in Crime No.39 of 2025, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner was found in illegal possession of 6 liters of arrack and 3150 kilogram jaggery.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. He further submitted that a false case has been foisted against the petitioner. Hence, he prays for anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.side) submitted that the petitioner was having illegal possession of 5 liters of Illicit Arrack. He would further submit that there are two previous cases, similar in nature, pending

against the petitioner. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the nature of offence committed by the petitioner, and taking note of the fact that there are two previous cases, similar in nature, pending against the petitioner, there is no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
