Prayer : Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorari calling for the records and quash the 2nd respondent's show cause notice in ROC No.110/2023 dated 22.11.2023 warning to lock and seal the residential building situated at RS 156/27B and 156/28B at 3/169, Manjoor Bazaar, Kundah Bridge Post, The Nilgiris District.

(Order of the Court was made by S.S. SUNDAR, J.) This writ petition is only to challenge the Show Cause Notice issued by the Executive Officer of the Kilkundah Town Panchayat, The Nilgiris District, dated 22.11.2023, under Section 145 of the Tamil Nadu Urban Local Bodies (Amended in 2022) Act, 1998, in respect of two different properties.

2.Except stating that the petitioner is going to apply for building plan permission and it will be considered by the respondents, the petitioner has not produced before this Court any approved plan so far obtained by the petitioner. In such circumstances, this Court is not inclined to entertain this writ petition challenging the Show Cause Notice. 3.Giving liberty to the petitioner to file his objections or explanation to the Show Cause Notice, this writ petition is dismissed. Till such time the explanation offered by the petitioner is considered and order is passed for demolition, the respondents need not disturb the petitioner. No costs.
