ORDER
The petitioner, who was arrested and remanded to judicial custody on 26.06.2025, for the offences punishable under Sections 103(1) @ 61(2), 103(1) and 49 of BNS in Crime No.717 of 2025, registered on the file of the respondent police, seeks bail. The earlier bail application of the petitioner was dismissed by this Court, vide order dated 09.09.2025 in Crl.O.P.No.24591 of 2025.

The case of the prosecution is that, on account of political enmity, the petitioner through his henchmen committed murdere of one Balamurgan. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 26.06.2025. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing 2/4
for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and states that there are totally 6 accused and the petitioner is arrayed as A3. He further submitted that the petitioner has 5 previous cases and he is also a history-sheeter in H.S.No.8671 of 2011; and that the investigation is pending.

Considering the facts, gravity of offence, the previous antecedents of the petitioner, there is no change of circumstances after dismissal of the earlier bail application in Crl.O.P.No.24591 of 2025 and the fact that investigation is pending, this Court is not inclined to grant bail to the petitioner.

Accordingly, this criminal original petition stands dismissed. 25.09.2025 stn 3/4
