... Respondents Prayer : Writ Petition filed under Article 226 of Constitution of India praying for issuance of a Writ of Certirorarified Mandamus calling for the records pertaining to the impugned order passed by the 5th respondent vide proceedings Lr.No.08/2023-2024 dated 27.07.2023 and quash the same, in consequence to that, direct the respondents to grant and disburse Hill allowances and other benefits.
For Petitioner : Mr.K.Anbarasan For Respondents : Mr.S.Arumugam Government Advocate
ORDER
This Writ Petition has been filed challenging the order dated 27.07.2023 in Lr.No.08/2023-2024 passed by the 5th respondent, thereby rejected the request made by the petitioner for grant of hill allowance and climate season allowance.
2. Heard the learned counsel appearing on either side and perused the materials available on record.
3. The petitioner was initially appointed as Secondary Grade Teacher and subsequently promoted to the post of Graduate Teacher (Maths). She was transferred vide the proceedings of the 4th respondent to Jarugumalai
Panchayat Union Middle School. She had joined in the said School on 01.06.2023 and she is continuously working therein. Therefore, she claimed hill allowance and climate season allowance, on the basis that the Jarugumalai is a hill area.
4. However, as per the Government Order, the said Jarugumalai is not coming under the hill area. If any area is declared as hill area then only the person, who is working in the hill area is entitled for hill allowance and other allowances.
5. Admittedly, as Jarugumalai is not declared as hill area, the petitioner is not entitled for any allowance. Therefore, the 5th respondent has rightly rejected the request made by the petitioner. Thus, the Writ Petition is devoid of merits and it is liable to be dismissed.
6. Accordingly, this Writ Petition stands dismissed. Consequently, connected miscellaneous petition is closed. No costs. 10.01.2024 Internet: Yes Index : Yes/No Speaking/Non Speaking order Lpp
