O R D E R
The present Criminal Original Petition has been filed seeking a direction to the learned Judicial Magistrate-I, Tambaram to take on file the final report in FR/RCS/No./15/2025 dated 14.05.2025 in Cr.No.49 of 2025 on the file of the respondent police.
2. Heard the learned counsel for the petitioner as well as the learned Government Advocate (Crl. Side) for the respondent.
3. The case of the petitioner is that his Two Wheeler Yamaha FZ V4 (Green) bearing registration No.TN-09-DH-3722 was found missing on 31.01.2025. He gave a complaint to the respondent and a case was registered in Cr.No.49 of 2025 on 02.02.2025 under Section 303(2) of BNS. Even after filing a final report by the respondent, the same was not taken on file by the Magistrate concerned. Aggrieved by the same, he has come forward with the present Petition.

The learned counsel for the petitioner submitted that the complaint given by the petitioner in regard to missing of his vehicle was registered in Cr.No.49 of 2025 and final report has also been filed on 14.05.2025, however after a lapse of four months, the case has not been disposed by the learned Magistrate, which causes grave hardships to the petitioner. Hence, he has filed the present Petition seeking the above relief.
5. The learned Government Advocate (Crl. Side), on instructions, submitted that the vehicle is not traceable, however, final report dated
14.05.2025 has been filed by the respondent through e-filing on 05.06.2025 before the learned Judicial Magistrate-I, Tambaram.
6. It is pertinent to note that the vehicle is not traceable by the respondent police, however, final report was filed through e-filing on 05.06.2025. Since the final report filed by the respondent has not been taken on file by the learned Magistrate, the petitioner is unable to claim insurance for his missing vehicle.
7. Hence, this Court directs the learned Judicial Magistrate-I, Tambaram to take the final report dated 14.05.2025 on file and give the closure report as expeditiously as possible, preferably within a period of four weeks from the date of receipt of a copy of this order.
8. With the above directions, the Criminal Original Petition stands disposed of.
