This petition has been filed seeking to condone the delay of 133 days in filing the appeal.

2.Heard the learned counsel appearing for the petitioner. The learned counsel appearing for the petitioner submits that the respondents 1 and 2 remained exparte before the Tribunal and hence notice to the respondents 1 and 2 may be dispensed with and has also made an endorsement to that effect in the bundle. In view of the above, notice to the respondents 1 and 2 is dispensed with. Though the name of the third respondent is printed in the cause list, there is no representation for the third respondent.

3.Being satisfied with the reasons stated in the affidavit filed in support of this petition, this petition is ordered and the delay of 133 days in filing the appeal is condoned.
