The present Writ Petition has been filed for an issuance of a Writ of Mandamus directing the respondents 1 and 3 to take appropriate department actions as against the 4th respondent and to consider the representation of the petitioner dated 17.10.2024

When the petition is taken up for hearing, the learned standing counsel appearing for the respondents has produced a Memorandum No.PAG(Audit-II) TN&PY/Legal Cell Miscl./2024-25/154 dated 08.01.2025 indicating that already appropriate action has been taken, therefore, pleaded to dismiss the petition as infructuous . Further the said Memorandum is hereby extracted as follows:- "It was brought to the notice of Administration that a Summon dated 18.10.2024 was addressed to Shri S.Edward Daniel Chandrasekar, Senior Audit Officer, BO-Puducherry, from the Dhanvanthri Police Station, directing the official to appear before the Inspector, on 19.10.2024 at 11.00 AM, based on a complaint from one Ms.Merlin Joe, Treasurer, North Tamil Conference. In this regard Shri S.Edward Daniel Chandrasekar, Senior Audit Officer, is directed to furnish the circumstances leading to the receipt of the Summon to the undersigned within five days of receipt of this Memorandum, failing which it will be construed that the official has no explanation to offer and further action as deemed fit will be taken.
Shri S.Edward Daniel Chandrasekar, Senior Audit Officer, is also directed to intimate further developments in this regard to the undersigned."
In view of the above, since the prayer in the Writ Petition to direct the respondents 1 and 3 to take appropriate departmental action against the 4th respondent has been duly complied with, the present Writ Petition is dismissed as infructuous. No costs.
