Prayer: Writ Petition filed under Article 226 of Constitution of India seeking issuance of Writ of Mandamus, directing the respondent to provide an opportunity of being heard before the erection of the Multi Circuit Tower in the land belonging to the petitioner in S.F.No.603/3C1.

ORDER

The petitioner herein seeks a direction to the respondent to provide an opportunity of being heard before the erection of the Multi Circuit Tower in the land belonging to the petitioner in S.F.No.603/3C1 at Kilkundah-I Village, Nilgiris District.

2. It is the case of the petitioner that he is owner of the above mentioned land and the respondent by his letter dated 18.06.2024 intimated the petitioner about his proposal to erect 230 KV Transmission Tower in the land of the petitioner and the same was objected by the petitioner by his letter dated 27.06.2024. However, the respondent has not considered the objection made by the petitioner and hence, he has come before this court seeking the above mentioned direction to the respondent.

3. Mr.D.R.Arunkumar, learned Standing Counsel, who takes notice for the respondent would submit that the objection made by the petitioner dated 27.06.2024 will be considered on its own merits.

4. In view of the submission made by the learned Standing Counsel, without going into the merits of the objection made by the petitioner, this Court is inclined to direct the second respondent to consider the objection of the petitioner and act in accordance with the provisions of Part III of Indian Telegraph Act. 5.With the above direction, this writ petition is disposed of. There shall be no order as to costs.
