O R D E R

Apprehending arrest in connection with Crime No.309 of 2024 registered for the offences punishable under Sections 296(b), 118(1), 351(1) of the Bharatiya Nyaya Sanhita, 2023, the present petition has been filed seeking anticipatory bail.

2. Pleading innocence on the part of the petitioner, false implication in the case, learned counsel for the petitioner seeks indulgence of this court. He would submit that this is third application for anticipatory bail. This court taking into consideration the fact that the injured was not discharged from the hospital

had dismissed the earlier application. He would submit that the injured now has been discharged from the hospital and the circumstances under which the incident has happened would go to show that the defacto complainant are the aggressors in this case. He would further submit that the petitioner is ready to abide by any stringent condition that may be imposed by this Court.

3. The case of the prosecution as putforth by the learned Government Advocate (Criminal Side) appearing for the respondent police, opposing for grant of anticipatory bail, is that, this is a third application for anticipatory bail. He would submit that this court taking into consideration the nature of injury and the manner in which the victim had been assaulted by the petitioner/accused had dismissed the earlier application. He would further submit that there was no change of circumstances in this case.

4. Heard the learned counsel for the petitioner, the learned Government Advocate (Criminal Side) for the respondent Police and perused the materials available on record, considering the facts and the submissions and also the finding that the injuries is grievous in nature and that there is no change of circumstances, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 21.01.2025 dsn
