The petitioner/A4, who was arrested and remanded to judicial custody on 27.11.2023 for the offences punishable under Sections 272, 273, 328 IPC r/w Section 6 and 24(1) of Cigarette and Other Tobacco Products Act, 2003 in Crime No.669 of 2023, seeks bail. 2.The learned counsel for the petitioner stated that the petitioner is an handicapped person and he is running a petty shop and from the shop, only 6 Kgs of banned tobacco products had been seized. 3.But, it is the case of the prosecution that the petitioner had procured the banned tobacco product and totally from all the four accused 774 Kgs of banned tobacco products had been seized. It is also asserted that the petitioner is the main accused. It is also stated that A1 and A2 had been detained under Tamil Nadu Act 14 of 1982 and A3 is still under custody.

smv 4.Taking all these factors into consideration and since investigation is still pending, at this stage, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
