ORDER
This Writ Petition is filed to direct the respondents 1 and 2 to recall/revoke the Lookout Circular issued to the respondents 3 and 4 in connection with the case in Crime No.39 of 2023 on the file of the 2 nd respondent by considering the petitioner's representation dated 11.11.2024 and 21.11.2024.
2. The learned counsel for the petitioner submitted that on account of 2/6
business transaction, the petitioner has to go to abroad or otherwise, he would loose his business and would suffer irreparable loss. The petitioner made representation before the 1 st respondent for seeking permission to go to abroad, but they have not considered the same and therefore, the present petition is filed.
2. The learned Additional Public Prosecutor appearing for the respondents police submitted that the investigation was already completed and the charge sheet was also filed before the Additional CCB Court, Egmore, Chennai, through e-filing and the same is yet to be taken on file.
3. It is seen that in this case, investigation completed and charge sheet has also been filed and hence the petitioner is at liberty to go to abroad after satisfying the conditions to be imposed by the trial Court and he is permitted to stay there only for a period of 20 days and thereafter, he has to come back to India. However, it is made clear that taking advantage of the order of this Court, the petitioner should not evade summons/warrant and he has to appear 3/6
before the trial Court, as and when his presence is required and he should not delay the process of trial for any reason. Further, whenever the petitioner wants to go back to abroad for business purpose or unavoidable circumstances, he has to obtain necessary permission from the trial Court for the same and without the prior permission of the trial Court, he should not leave India.
4. With the above directions, this Criminal Original Petition is disposed of. Consequently, connected Miscellaneous Petition is closed. 09.12.2024 Index : Yes / No Speaking Order : Yes / No ksa-2 4/6
