Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing respondents 1 to 5 to take immediate action on the representation of the petitioner trust dated 17.03.2025 to protect the water body classified as Nilaviyal Kuttai in Revenue records comprised in Old Survey No.350/4, New survey No. 250/10 measuring an extent of 0.54.0 Hectares (1.32 Acres) in Kottakuppam village, Vanur Taluk, Villupuram District from illegal encroachment within a reasonable time.

ORDER
(Order of the Court was made by the Hon'ble Chief Justice) By way of this public interest litigation, the petitioner seeks to challenge the grant of patta in favour of respondent No.7. It is reflected from the records that patta was granted long back to the father of respondent No.7, which is now sought to be challenged by the petitioner.
2. This can be considered only in an inquiry, on an application seeking cancellation of patta, to be submitted before the competent revenue authority. Therefore, we give the petitioner liberty to submit an application, raising all the grounds which have been raised in this
petition, along with material against grant of patta.
3. It goes without saying that the authorities shall examine the allegations and take appropriate decision in accordance with law. The patta holder shall be afforded an opportunity of hearing.
4. Before parting with the case, we may hasten to add that we have not commented upon the merits of the case.
5. The petition stands disposed of. There will be no order as to costs.
