Prayer: Civil Revision Petition is filed under Article 227 of the Constitution of India, to direct the learned District Munsif cum Judicial Magistrate, Neyveli, to dispose of the pending original suit vide OS No. 01 of 2017.

The Civil Revision Petition is filed seeking an early disposal of OS No. 01 of 2017, on the file of the District Munsif - Cum - Judicial Magistrate Court, Neyveli.

2. The suit has been filed by the 1st respondent herein seeking partition. The petitioner herein is the 2nd defendant in the said suit. It is seen that pending the suit, the 1st respondent / plaintiff has taken out an application in I.A.No. 107 of 2018, seeking to implead two persons, namely, Sivasankaran and Dhandapani. It is further seen that the 2nd and 3rd respondents in the said application have filed a counter. However, the said application has not been disposed of to date.

3. Considering the above, the District Munsif - Cum - Judicial Magistrate Court, Neyveli, is directed to dispose of the IA, within a period of 1 month from the date of receipt of a copy of this order and within a period of 3 months therefrom, the District Munsif - Cum - Judicial Magistrate Court, Neyveli, shall dispose of the suit. 2/5

4. The Civil Revision Petition is disposed of with the above directions. No costs.
