Respondents Prayer : Writ Petition filed under Article 226 of Constitution of India praying for issuance of Writ of Mandamus directing the 2nd and 3rd respondent to survey and fix the boundaries of the property measuring

2.25 ares (5.56 cents) in Old S.F. No.723, 723/1, New SF. No.723/1B in Joint Patta No.6317, situated at Neelambur Village, Sulur Taluk, Coimbatore District, and to carry out the said process with adequate police protection from the 4th and 5th respondents based on the application dated 25.08.2025.

ORDER

This Writ Petition has been filed seeking a direction to the second and third respondents herein to survey the petitioner's property measuring 2.25 ares (5.56 cents) comprised in Old S.F. No.723, 723/1, New SF. No.723/1B in Joint Patta No.6317, situated at Neelambur Village, Sulur Taluk, Coimbatore District, based on the petitioner's representation dated 25.08.2025.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner owned a property comprised in Old S.F. No.723, 723/1, New SF. No.723/1B in Joint Patta No.6317, situated at Neelambur Village, Sulur Taluk, Coimbatore District. In order to survey the said land, the petitioner submitted an application before the respondents 1 to 3 and also paid requisite fees for the same. So far the respondents did not take any steps to survey and demarcate the property belongs to the petitioner. Hence, this writ petition.

In view of the above, the second respondent is directed to survey the petitioner's aforesaid property based on the title deed produced by the petitioner, after issuance of notice to the adjacent land owners and counter parties, if any, and to serve the survey report to the petitioner within a period of six weeks from the date of receipt of copy of this order. It is made clear that, if the surveyor concerned is obstructed by third parties while surveying the subject property, the said surveyor can approach the jurisdictional police seeking police aid and on such request, the jurisdictional police shall provide adequate police protection to the surveyor.

5. With the above direction, this writ petition is disposed of. There shall be no order as to costs.
