ORDER

The petitioner, who was arrested and remanded to judicial custody on 16.08.2025 based on execution of NBW dated 08.09.2022 in C.C.No.07 of 2017 on the file of the learned Judicial Magistrate-I, Ariyalur, for the offences punishable under Sections 294(b), 417, 420 and 506(i) of IPC in Crime No.07 of 2019 on the file of the respondent police, seeks bail. 2.

The learned counsel appearing for the petitioner submitted that the petitioner was falsely implicated in the case; that the petitioner was confined in Qatar Central Prison in connection with Cheque Cases vide No.1872/2021 and 2151/2019 and due to which, the petitioner was not able to appear before the Trial Court, thereby a NBW was issued against the petitioner and further proceedings regarding Look-out Notice was also issued. He further submitted that the petitioner had not received any summons, intimation or communication regarding the pendency of this case; that while so, when the petitioner returned to India, he was immediately arrested on execution of NBW by the respondent police on 16.08.2025. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the 2/4

petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner submitted that the petitioner herein along with his family members had cheated a sum of Rs.22,70,481/- from the defacto complainant, who is running a man power agency, under the guise of arranging jobs in Qatar; that at the time of registering of FIR, the petitioner was in abroad, thereby absconding charge sheet was filed against the petitioner; that since the petitioner failed to appear before the Trial Court, a NBW was issued on 08.09.2022 and while the petitioner returned to India on 13.08.2025, NBW was executed and he was arrested on 16.08.2025. He further submitted that the case is posted for examination of LW1 to LW3, no amount has been recovered yet and the petitioner has absconded for nearly three years. 4.

Considering the facts of the case, the charges against the petitioner, the petitioner has absconded for a longer period, taking note of the fact that no amount has been recovered yet and the trial is also in the preliminary stage, this Court is not inclined to grant bail to the petitioner at this stage.
