Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus by calling for the records pertaining to order bearing No.F/SCSVMV/REG/EST/PF/2016-17/01267, dated 29.09.2016 issued by the seventh respondent and to quash the same and consequently direct the fifth respondent to consider the petitioner's appeal dated 03.11.2017 and reminder dated 29.11.2021 by reinstating the petitioner in service with all attendant and consequential benefits including back wages. ORDER

This writ petition has been filed to issue a Writ of Certiorarified Mandamus by calling for the records pertaining to order bearing No.F/SCSVMV/REG/EST/PF/2016-17/01267, dated 29.09.2016 issued by the seventh respondent and to quash the same and consequently to direct the fifth respondent to consider the petitioner's appeal dated 03.11.2017 and reminder dated 29.11.2021 by reinstating the petitioner in service with all attendant and consequential benefits including back wages.

On perusal of records, the petitioner failed to file any acknowledgment or proof to show that the petitioner filed an appeal on 03.11.2017. Further, the petitioner has sent reminder on 29.11.2021. However, for reminder also, there is no proof to show that the reminder was sent on 29.11.2021.

The learned Government Advocate appearing for the first respondent submitted that no appeal is pending so far. 4.

Therefore, the direction sought for in this writ petition cannot be considered. As such, this writ petition is devoid of merits and liable to be dismissed. Accordingly, this writ petition is dismissed. Consequently, connected miscellaneous petition is closed.
