This Civil Revision Petition has been filed by the petitioners seeking for a direction to the Principal Subordinate Court, Coimbatore, to dispose of the suit in O.S.No.400 of 2021 within a time frame fixed by this Court.

2. The case of the petitioners is that the petitioners herein are defendants 1 and 2 in the suit filed by the first respondent/plaintiff before the Principal Subordinate Court, Coimbatore, in O.S.No.400 of 2021 seeking for a declaration, partition and permanent injunction. It is the further case of the petitioners that they 2 / 5

have filed an application seeking to reject the plaint and the same was taken on file in I.A.No.2 of 2022 on 05.10.2021 and the 1st respondent had filed the counter on 01.02.2023. However, despite the same, the application in I.A.No.2 of 2022 has been repeatedly adjourned without any effective hearing, thereby, the present petition has been filed seeking for a direction to the trial Court to dispose the suit in O.S.No.400 of 2021 as expeditiously as possible.

3. Heard the learned counsel for the petitioners and perused the materials available on record including the adjudications in O.S.No.400 of 2021 affixed by the petitioners along with the petition.

4. A perusal of the record shows that the 1st respondent/plaintiff has filed the suit in the year 2021 and the application filed by the petitioners seeking to reject the plaint is also pending from the year 2022 and the same has been adjourned on several occasions without any effective hearing.

5. In view of the above, this Civil Revision Petition stands disposed of with a direction to the learned Principal Subordinate Judge, Coimbatore, to dispose of 3 / 5

the application in I.A.No.2 of 2022, as expeditiously as possible, preferably, within a period of three months from the date of receipt of copy of this order. No costs.
