(TM)A.94/2023 is filed by the respondent in (T)OP(TM)/5/2023 for taking an additional counter of the respondent onto the file. 2.The learned counsel for the 1st respondent would submit that an additional counter indeed had been filed even when the matter was pending before the IPAB, however, it was not taken on record by the Tribunal. It is hence, the respondent is constrained to file the present application for taking on record the counter already filed before IPAB. 3.The petitioner in the O.P. / respondent in this application has filed its counter.

kas 5.Inasmuch as the additional counter of the respondent had been filed even before IPAB and since it is a part of one's pleadings, this Court deems it appropriate to allow this application.

4.This application stands allowed accordingly. The additional counter is taken on record. The petitioner is now at liberty to file its rejoinder if it so desirous.
