Learned counsel for the petitioner would submit that the respondent had neither disputed the signature in the cheque nor rebutted the statutory presumption.
However, the learned Magistrate had erroneously acquitted the respondent only on the ground that the petitioner had not established his capacity to lend a sum of Rs.15 lakhs and that he had not filed income tax returns and that the petitioner had established that the cheque was issued for legally enforceable debt.

The points raised by the learned counsel for the petitioner require consideration. Hence, leave granted.
