ORDER

This Criminal Miscellaneous Petition has been filed to modify the condition imposed by this Court in Crl.R.C.No.1619 of 2025 dated 03.09.2025 in para 6(ii) that the petitioner shall deposit the original registration certificate of the vehicle with the concerned Magistrate.

2. The learned counsel for the petitioner submitted that in order to get the fitness certificate, the R.C.book is necessary. Therefore, he needs a direction to get the original R.C. Book from the trial court and filed the present petition seeking to modify the condition.

3. The learned Government Advocate (Crl.Side) appearing for respondent raised strong objections for return of original R.C. Book.

4. Considering both side submissions and the fact that in order to get the fitness certificate, the original R.C. Book is necessary. Therefore, this Court is inclined to direct the Judicial Magistrate No.1, Tambaram to return the original R.C.book within a period of four weeks from the date of receipt of copy of this 2/4

order and after the compliance of proceedings, the petitioner is directed to return the original R.C.Book to the court on or before 08.11.2025. If any necessity arose for the petitioner requiring original R.C. Book, the trial court can hand over the original R.C.Book with interim custody in future, except that the R.C. Book not to be used for any other purpose or for creating encumbrance.

5. Except the above modification, the other conditions imposed by this Court in Crl.R.C.No.1619 of 2025 dated 03.09.2025 shall remain unalterted.
