Prayer: Writ Petition is filed under Article 226 to issue a Writ of Mandamus, directing the 2nd and 3rd respondents to survey the lands and to fix boundary stones in survey Nos. 1056/4, 1057/ 6, 1057/7 in Kurichi Village, Bhavani Taluk, Erode District, on the basis of the petitioner's representation dated 06.03.2024. O R D E R

The above Writ Petition has been filed seeking mandamus to direct the 2nd and 3rd respondents to survey the lands and to fix boundary stones in survey Nos. 1056/4, 1057/ 6, 1057/7 in Kurichi Village, Bhavani Taluk, Erode District, on the basis of the petitioner's representation dated 06.03.2024.

2. The petitioner purchased the subject properties on 21.12.2022, 2/6

by way of a registered sale deed in Doc.No.4405/2022. The petitioner would submit that the patta as well as A - Register, stands in his name. The petitioner would submit that he has made an application on 06.03.2024, for surveying the property. Since, there is no response the petitioner is before this Court.

3. Heard the learned counsels on the either side and perused the records.

4. Considering the facts and circumstances of the case, the 2nd respondent is directed to conduct survey of the subject property. The petitioner shall submit all the relevant records to show his title to the property and the 2nd respondent shall, after issuing notice to the adjacent land owners and interested parties, hold an enquiry and thereafter, proceed to pass orders either surveying and subdividing the property or rejecting the request. In the case of a rejection, a speaking order shall be passed. The said exercise shall be completed within a period of 6 weeks from the date of receipt of a copy of this order. 3/6

5. The Writ Petition is allowed. No costs.
