ORDER
The relief sought for in this writ petition is to direct the first respondent herein to dispose of the petitioner's appeal petition dated 04.06.2025 as against the order dated 21.05.2025 vide Order No.16/2025 under Ref.No. e/f/vz;/315-2023-m1-j/kh/t/m-jpUts;Sh; passed by Special District Revenue Office (LA), the 3rd respondent herein.
2. Mr.P.Sathish, learned Additional Government Pleader takes notice on behalf of the respondents. By consent of both the parties, this writ petition is taken up for final hearing at the admission stage itself.
3. The case of the petitioner is that the petitioner is the absolute owner of the land comprised in Old S.No.289/1 and New S.No.344/3 of 2/6
No.14, Madarpakkam Village, Gummidipoondi Taluk, Tiruvallur District, to a total extent of 2.67 Acres, which is acquired by the third respondent and awarded meagre compensation, without giving any opportunity of being heard and communication. Thus, a representation was given by the petitioner, requesting the third respondent to consider by giving pathway for access to the factory from the main road, which is a part of S.No.344/3. The third respondent herein by virtue of proceedings dated 21.05.2025, has rejected determination of the access comprised in S.No.344/3 in 1.08.00 Ares and had deposited a sum of Rs.1,36,27,001/- before the Thiruvallur Court and thus there was no feasibility of considering the request of the petitioner. Challenging the said order, the petitioner has made an appeal before the first respondent and the same is pending without passing any orders. Hence, the petitioner has come forward with the present writ petition.
4. Though many grounds have been raised in this writ petition, learned counsel for the petitioner submitted that it would suffice, if this 3/6
Court issues direction to the first respondent to dispose of the petitioner's appeal dated 04.06.2025.
5. Learned Additional Government Pleader appearing for the respondents submitted that the petitioner's appeal dated 04.06.2025 would be considered and appropriate orders passed within a time frame to be fixed by this Court.
6. Heard the learned counsel on either side and perused the materials available on record.
7. Considering the submission made by the learned counsel on either side, this Court without going into the merits of the case, directs the first respondent to consider and dispose of the petitioner's appeal dated 04.06.2025, after giving due notice and opportunity of personal hearing to the petitioner as well as aggrieved persons, if any, within a period of four weeks from the date of receipt of a copy of this order. With the aforesaid direction, this writ petition is dispose of. No 4/6
costs.
