ORDER
Challenging the impugned order passed in I.A.No.1 of 2024 in O.P.No.3488 of 2024 by the learned VI Additional Family Court, Chennai, the Revision Petitioner wife preferred this Civil Revision Petition. 2.Before the trial court, originally, the Revision Petitioner wife filed a divorce petition before the Family Court, Bhuvaneshwar and the same is now transferred to the present court viz., VI Additional Family Court, Chennai. Now, she found that the respondent husband made false, frivolous and fictitious allegations against her in order to malign her. Hence, she wanted to file a reply to the counter, but it was not granted by the trial judge. Aggrieved over that, she has preferred this Civil Revision Petition.
3.On seeing the facts, it reveals that now the trial has begun. At this stage, she wanted to file a reply to the counter filed by the respondent husband. If opportunity is not given to her, her right to defend the case will be defeated. The reasons assigned by her is justifiable one. Considering that, this Court is inclined to set aside the findings rendered in I.A.No.1 of 2024 in O.P.No. 3488 of 2024 by the VI Additional Family Court, Chennai. Liberty is granted to the revision petitioner wife to file her reply to the counter and if necessary, an
additional proof affidavit is also ordered to be filed. Accordingly, this Civil Revision Petition is allowed. No costs. Consequently, connected civil miscellaneous petition is closed.
