Apprehending arrest in connection with Crime No.426 of 2024 registered for the offences punishable under Sections 4(1) (c), 4(1) (A) of Tamil Nadu Prohibition (Amendment) Act, 2024 , the present petition has been filed seeking anticipatory bail.
2. The case of the prosecution is that, when the respondent police were conducting raid at Villupuram GRT Street, they found the petitioner and his daughter were illegally selling brandy bottles. Thereafter, the respondent police seized 35 brandy bottles, each contains 90 ml from the petitioner's daughter and arrested her, whereas the petitioner escaped from the spot. Hence, this case
3. Pleading innocence on the part of the petitioner, false implication in the case, learned counsel for the petitioner seeks indulgence of this court. He would submit that the petitioner is ready to produce solvent sureties and ready to abide by any stringent condition that may be imposed by this Court.
4. The case of the prosecution as putforth by the learned Government
Advocate (Criminal Side) appearing for the respondent police, is that, the petitioner along with his daughter had involved in illegal selling of 35 Nos'. of brandy bottles. He would further submit that the petitioner is an habitual offender, having 17 previous cases. He would further submit that this is a second anticipatory bail petition and earlier petition in Crl.O.P.No.28563 of 2024 of the petitioner was dismissed on 19.11.2024.
5. Heard the learned counsel appearing for the petitioner, the learned Government Advocate (Crl.Side) appearing for the respondent Police and perused the materials available on record.

Taking into consideration the above facts and circumstances of the case, the submissions made by the learned counsel on either side and taking into consideration that the petitioner is an habitual offender and having 17 previous cases, and there is no change in circumstances, hence, this Court is not inclined to grant anticipatory bail to the petitioner.
