ORDER

The petitioner, who was arrested and remanded to judicial custody on 02.08.2025, for the offences punishable under Sections 305(a) and 331(4) of BNS (under Sections 380 and 457 of IPC) in Crime No.555 of 2024, registered on the file of the respondent police, seeks bail. 2.

The case of the prosecution is that the petitioner along with other accused broke open the jewellery shop of the defacto complainant and taken away 9 kilograms of silver articles. Hence, this case. 3.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 02.08.2025. He further submitted that the petitioner is not a named accused in the FIR and the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the 2/4

prosecution case and states that there are totally 4 accused and the petitioner is arrayed as A1 and has 6 previous cases of similar nature; that the petitioner is hailing from Andhra Pradesh, there is every possibility of released on bail, he may also abscond; and that the investigation is pending. 5.

Considering the facts, gravity of offence, the previous antecedents of the petitioner and the fact that investigation is pending, this Court is not inclined to grant bail to the petitioner. 6.

Accordingly, this criminal original petition stands dismissed. 25.09.2025 stn 3/4
