ORDER

Heard Mr.S.Mohamed Uduman, learned counsel for the petitioner and Mr.P.Balathandayutham, learned Special Government Pleader for the respondents.

2. This Court while disposing the Writ Petition directed the respondents to pay the subsistence allowance as per Rules. Now, it is stated by the respondents that the subsistence allowance had been paid till January and it will be continued to be paid as per Rules. It is the specific stand of the respondents that despite action taken in this regard, the applicant is not co-operating and he had sought time for 45 days when the notice was issued to him in this regard.

3. The learned counsel appearing for the petitioner submitted that the petitioner had already challenged the charge memo issued to him. 2/4

4. When the petitioner himself is not co-operating in the proceedings, he cannot maintain a contempt petition. Hence, this Contempt Petition is closed.
