ORDER

This petition has been filed seeking direction to the respondent to comply the order passed by the Learned Judicial Magistrate, Vaniyambadi, Tirupathur District in CMP.No.4012/2021 dated 20.04.2023.

2. It is the case of the petitioner that one Chinnakutti and others with the intention to grab the property of the petitioner, went to the petitioner's house along with henchman and assaulted the petitioner and his mother and stole the documents related to the property and some gold jewels. Hence, he filed a complaint before the respondent Police and an FIR in Crime No.361 of 2019 was made against the accused for the offences under Sections 147, 323 and 379 of IPC. Subsequently, the respondent filed referred final report, with the remark of "Mistake of Fact". Later, protest petition has been filed by the petitioner. On such petition, the Magistrate directed the respondent Police to conduct further investigation.

3. The Govt. Advocate (Crl. Side) appearing for the respondent on instructions submitted that further investigation is still pending.

4. Considering the above submissions, it is clear that further investigation is pending. Therefore, the respondent Police shall conduct further investigation as ordered by the Magistrate and file a final report before the Magistrate expeditiously.
