ORDER
Heard.
2. The petitioner/wife seeks withdrawal of I.D.O.P.No.40 of 2025 pending on the file of the Family Court, Uthagamandalam, and transfer of the same to the Family Court, Coimbatore.
3. The said I.D.O.P. is a matrimonial proceeding instituted by the respondent/husband.
4. The petitioner states, in substance, that she is residing at/around Sulur, Coimbatore, that she is not independently employed and is dependent on her aged mother, and that repeated travel to Uthagamandalam for every hearing causes serious practical hardship, expense and difficulty. It is also stated that maintenance proceedings and domestic violence proceedings are pending at/around Sulur/Coimbatore, and that the respondent is employed and would not face comparable hardship if the matter is tried at Coimbatore.
5. Having regard to the petitioner's stated residence at Coimbatore region, her pleaded financial and personal constraints, and the fact that connected 2/5
proceedings are stated to be pending within Coimbatore jurisdiction, this Court is satisfied that continuation of the matrimonial case at Uthagamandalam would cause avoidable hardship to the petitioner. Transfer to Coimbatore would mitigate such hardship, while preserving the respondent's right to prosecute the main case on merits before the transferee Court.
6. Accordingly, Tr.C.M.P.No.1053 of 2025 is allowed. I.D.O.P.No.40 of 2025 pending on the file of the Family Court, Uthagamandalam is withdrawn and transferred to the file of the Family Court, Coimbatore, for disposal in accordance with law.
7. The Family Court, Uthagamandalam shall transmit the entire records to the Family Court, Coimbatore forthwith. The transferee Court shall take the matter on file on receipt of records and proceed in accordance with law. C.M.P.No.23802 of 2025 is closed.
