Respondent(s) PRAYER : Criminal Original Petition filed under section 528 of BNSS to direct the 2nd respondent police not to harass the petitioners under the guise of enquiry on the false complaint lodged by Chandrasekar Reddy and pass such further or other or other orders as this Honble Court may deem fit and proper in the circumstances of the case.

ORDER

This Criminal Original Petition has been filed to direct the second respondent police not to harass the petitioners under the guise of enquiry on the false complaint lodged by one Chandrasekar Reddy.

2. The case of the petitioners is that there is civil dispute between the petitioners and the defacto complainant and in this regard a suit in O.S.No.25 of 2008 has been filed for recovery of possession and a suit in O.S.No.16 of 2025 has been filed for permanent injunction by the petitioners and the same are pending. While so, the defacto complainant had lodged the present complaint against the petitioners and on the basis of the same, the second respondent is threatening the petitioners under the guise of enquiry. Hence, the present petition has been filed.

3. The learned Government Advocate [Criminal Side] on instructions submitted that a current paper enquiry is pending against the petitioners.

4. Such being the position, it is for the investigating agency to issue appropriate notice to the petitioners under Section 35(3) of BNSS for enquiry and on such notice, the petitioners shall appear for enquiry and co-operate with the investigation. If any cognizable offence is made out, the second respondent shall proceed as per law.

5. With the above direction, this Criminal Original Petition is disposed of.
