Respondents Prayer :- Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the first respondent to grant an order of stay in the petitioner's appeal petition or to decide the appeal petition dated 11.07.2025 filed against the order dated 19.06.2025 made in Se.Mu.No.(A4) 894/2025 passed by the second respondent. This writ petition has been filed for direction to the first respondent to grant an order of stay in the appeal petition or to decide the appeal within a stipulated time.

Heard, the learned counsel appearing on either side and perused all the materials placed before this Court. 3.

It is seen from the records that the petitioner submitted appeal before the first respondent against the order passed by the second respondent dated 19.06.2025. However, no interim order was passed by the first respondent while entertaining the appeal. 4.

On instruction, the learned Special Government Pleader appearing for the respondents submitted that the petitioner did not file any application for stay.

However, on perusal of records, it is revealed that along with the appeal, the petitioner submitted application for interim order since the petitioner is in possession and enjoyment of the subject property even 2/4

after cancellation of assignment patta.

In view of the above, the first respondent is directed to pass orders on the stay application filed by the petitioner within a period of one week from the date of receipt of copy of this order. Further, the first respondent shall dispose of the main appeal itself within a period of twelve weeks thereafter after giving opportunity of personal hearing to all necessary parties.

With the above directions, this writ petition is disposed of. There shall be no order as to costs.
