The petitioner, who apprehends arrest at the hands of the respondent police for the offence under Section 303(2), & 326(a) of BNS Act in Crime No.237 of 2025, on the file of the respondent Police, seeks anticipatory bail. 1/4

2. The allegation against the petitioner is that he illegally quarrying half unit of river sand in Shankarabarani river in a bullock cart. Hence, the case has been registered.

3. The learned counsel for the petitioner submitted that the petitioner is not having any previous case and the property also recovered. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and submitted that investigation in this case is still pending. Hence, he oppose to grant anticipatory bail to the petitioner.

5. Considering the above facts and circumstances of the case, the petitioner have illegally quarried sand from Shankarabarani river which is the lifeline of various Districts and since they also caused damage to the ecology and water body, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed. 24.09.2025 ssi 2/4
