Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, directing the respondents to pay me the arrears of Rs.91,73,181/- towards arrears of salary, earned leave, gratuity and provident fund, along with the interest at the rate of 18% per annum from the date of due, i.e., from 01.01.2005 to till the date of settlement, within the time to be stipulated by this Court, by considering the petitioner's representation dated 30.09.2024. ORDER
It is the case of the petitioner that he worked as an Attender in respondents 3 and 4 / Society and retired from service on 31.03.2024 and his terminal benefits are not settled by the respondents 3 and 4 as on date. It is also further case of the petitioner that the salary, that is payable to the petitioner, is also not paid as per his entitlement right from the year 2005 and thereby, there are arrears of salary to the tune of Rs.91,73,181/-. 2.In the light of the above, the petitioner claimed to have submitted his representation dated 30.09.2024 before the respondents 1 to 4 by sending the same by registered post acknowledgement due and the said representation is also stated to have been served on all the respondents. But the respondents have not taken any action on such representation and hence, the petitioner approached this Court by filing the present writ petition seeking writ of mandamus.
3.Heard Mr.S.A.Syed Shuhaibb, learned counsel for the petitioner and Mr.B.Tamil Nidhi learned Additional Government Pleader for the respondents 1 & 2.
4.The grievance of the petitioner is only non consideration of the representation dated 30.09.2024 said to have been submitted before the respondents. Therefore, this Court is not inclined to go into the merits of the case. In the considered view of this Court it would be suffice if the said representation is directed to be considered by the respondents. Page No.3 of 6
5.Accordingly, the writ petition is disposed of by directing the respondents 3 and 4 to consider the representation dated 30.09.2024 said to have been submitted by the petitioner and pass appropriate orders thereon as expeditious as possible at any rate within a period of six weeks from the date of receipt of a copy of this order.
