PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Certiorari to call for the records of the first respondent in his proceedings DO:DGM:(JKG): DA;398/1999 dated 11th November 1999 as affirmed by the second respondent in his proceedings No.DO:GM:(RV)/AA:251/2000 dated 17.11.2000 and quash the same.

ORDER

Learned counsel for the petitioner submitted that he has already filed a memo, stating as follows:

"It is humbly submitted that the writ petition has been filed challenging the order of penalty of "Discharge from Bank's service" passed against the petitioner herein and this Honourable Court issued Rule Nisi and the respondents have filed counter affidavit. When the matter was first listed before this Honourable Court for final hearing, a letter was sent to the petitioner https://hcservices.ecourts.gov.in/hcservices/

informing the same. However there was no response from the petitioner's side and upon local enquiry through another client, it was learnt that the petitioner passed away some time ago. No legal representative of the petitioner approached the Counsel in this regard."

2. With a view to give one more opportunity to the writ petitioner, the matter was adjourned by two weeks on 28.03.2017. Again it is listed today i.e 26.04.2017.

3. The learned counsel appearing for the writ petitioner once again reiterated that he is unable to get instructions from the client and accordingly, based on the memo already filed on 28.03.2017, the writ petition may be disposed of.

4. In view of the said submission, the writ petition is dismissed. No costs.
