ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. The case was registered in Cr.No.82 of 2006 for the alleged offence under Section 302 of Indian Penal Code, 1860.The allegation against the accused is that he murdered his wife. There are no other relatives of the accused or the victim. Non Bailable Warrant is pending against the accused. The case is pending from the year 2006.

3. Considering the fact that warrant is pending from 2006 and Non Bailable Warrant could not be executed. This an extraordinary case in exercise of power under Article 226 of the Constitution of Indian and Section 482 of Cr.P.C, the case can be deemed to be closed with liberty that if the accused resurfaces, the case can be reopened and continued further. Even if any clue is obtained in future also, the same shall be re-opened and the case be conducted.

4. Accordingly, the case in PRC.No.100049 of 2009 on the file of District Munsif Cum Judicial Magistrate, Denkanikottai Taluk, Krishnagiri stands closed. This Suo Motu Transfer Case is disposed of. 22.09.2025 rap electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
