This petition is filed to condone the delay of 41 days in filing the above said Civil Miscellaneous Appeal.

2. In view of the endorsement made by the learned counsel for the petitioner/appellant, notice to the 1st respondent is dispensed with, since he remained ex-parte before the Tribunal.

3. Heard Mr.S.Ravikumar, learned counsel for the petitioner/appellant and Mr.J.Chandran, learned counsel, who takes notice on behalf of the 2nd respondent.

4. Sufficient reasons have been given in the affidavit filed in support of the petition. Accordingly, the delay is condoned and the petition is ordered.

5. Registry is directed to number the appeal, if it is otherwise in order and print the name of Mr.J.Chandran as learned counsel for the 2nd respondent when the same is listed for admission.
