Respondents Prayer : Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the 2nd respondent to consider the representation dated 08.07.2025 and remove the encroachment of fencing made by the 3rd respondent in survey No.211 Gramam Natham (Vandipathai) in Palavedu Village, Avadi Taluk, Tiruvallur District.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) In response to the allegation that encroachment has been made by raising fence in government land, classified as grama natham (pathway), learned State counsel, upon instruction, would submit that as far as fencing part is concerned, the same has been removed. Towards removal of encroachment made in the form of small construction, action has been initiated by issuing notice under Section 7 of the Land Encroachment Act.

2. Taking into consideration the aforesaid submission and placing on record the same, we are not inclined to keep this petition pending, but to dispose it of with direction to the official

respondents to conclude the proceedings initiated by issuing notice under Section 7 of the Act, as early as possible, preferably within three months.
