ORDER

The Criminal Original Petition has been filed to call for the entire records in Cr.No.568/2024, pending on the file of the 1st respondent police and quash the same.

2. When the matter was taken up for hearing on an earlier occasion, this Court by order dated 12.11.2025, had directed the first respondent police to appear before this Court with proof on 17.11.2025, that the charge sheet was filed before the Court concerned on 12.05.2025 itself.

3. The learned counsel for the petitioner would submit that the alleged incident is said to have happened when the petitioner had come out of the restaurant after having his dinner. The victim had come in a rash and negligent manner and dashed against the vehicle of the petitioner when he was backing out. Since the victim had died, the respondent police had registered a case against the petitioner on the ground that he is responsible for the accident.

The learned Government Advocate (Crl.Side) would submit that the investigation has been completed, the final report has been filed and the case has been taken up for trial in C.C.No.675/2025 on the file of the learned Judicial Magistrate, Kangeyam. However, he would fairly concede that the charge sheet

was not filed on 12.05.2025 but only on 13.11.2025. On the earlier occasion, it was submitted by the respondent police that the charge sheet has been filed on 12.05.2025 itself. He would further submit that due to inadvertence, wrong information has been given on the earlier occasion that charge sheet was filed on 12.05.2025 itself, however, the officer is ready to file an affidavit of apology.

5. This Court finds that the officer who was present before this Court on the earlier occasion has given wrong information and now it is reported that the final report is filed.

6. In view of the above, this Criminal Original Petition is disposed of with liberty to the petitioner to challenge the final report, if so advised. Consequently connected miscellaneous petition is closed.
