Prayer: Writ Petition is filed under Article 226 of the Constitution of India for issue of Writ of Mandamus, directing the respondents to disburse the earned leave calculated at the rate of 32 days per year from 01.01.1990 till the date of the petitioner's retirement together with interest @ of 18% pa for the delayed period from 31.05.2022 till the date of payment at the earliest. 1/5

O R D E R

The Writ Petition is filed for the following relief: "directing the respondents to disburse the earned leave calculated at the rate of 32 days per year from 01.01.1990 till the date of the petitioner's retirement together with interest @ of 18% pa for the delayed period from 31.05.2022 till the date of payment at the earliest".

2. The petitioner states that he joined the services of 2nd respondent in the year 1996 as a Casual Labourer and retired on 31.05.2022 as a Junior Factory Assistant in the 2nd respondent's office. The petitioner states that all retirement benefits were paid except earned leave encashment.

3. The petitioner would submit that the Government Order dated 24.05.2018 mandates calculation of earned leave at 32 days per year from 2/5

01.01.1990 and payment at retirement. The petitioner states that he sent representation on 25.07.2025 but no payment has been made. The petitioner would submit that in WP.No.20657 of 2022, this Court ordered a similar payment with 18 % interest. Therefore, the petitioner is before this Court seeking the prayer extracted above.

4. Heard the learned counsels and perused the records.

5. Considering the fact that the petitioner is entitled to earned leave encashment and the fact that his representation has not been considered, this Writ Petition is allowed. The 2nd respondent is directed to disburse the amount due under the head earned leave encashment with interest at the rate of 18% p.a., within a period of 2 months from the date of receipt of a copy of this order. No costs.
