Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the respondents 3 and 4 to measure the water channel running in S.No.189, 190 & 191 of Eyankunam village, Melmalaiyanur Taluk and remove the encroachment made by the 5th respondent over the said water channel by considering the representation of the petitioner dated 08.08.2022 made to the 1st respondent.

ORDER

(Made by the Hon'ble Chief Justice) We have heard Mr.B.Jawahar, learned counsel for the petitioner and Mr.A.Edwin Prabakar, learned State Government Pleader for the respondents 1 to 4.

2. The writ petition is filed as a public interest litigation seeking directions to remove the encroachment made by the fifth respondent in the water channel.

3. Learned State Government Pleader, on instructions, submits that the land has been surveyed and the petitioner is a major encroacher on the said water channel. Form I has been issued to the Block Development Officer and further steps would be taken for eviction of encroachment expeditiously.

4. In view of the said statement, the writ petition is disposed of. There shall be no order as to costs.
