Heard both sides and perused the records.

The present miscellaneous petitions are filed by the petitioner praying for an order of interim injunction restraining the 6th respondent from in any manner carrying out renovation or construction works to the demolished area in front of Sri Pasupatheeswarar Temple, Pandhanallur, Mayiladuthurai District.

In the order dated 08.02.2024 passed in WP.No.2834 of 2024, a learned Judge, while considering the claim of the petitioner therein, seeking a direction to forbear the authorities from making any permanent structure in and around Holy Tank / Teppakulam in the land owned by the Pasupatheeswarar Temple, has recorded in paragraph nos.6 and 7, as follows: "6.The learned Special Government Pleader for the respondents 1 to 4 produced the allotment of funds and necessary permissions accorded to erect Annadhana Koodam. If the Archaeological Department issues no objection certificate, the same cannot be issued without taking into account of environmental features surrounding the temple teppakulam. The respondents have not initiated any action to construct Annadhana Koodam without any permission from the appropriate authority and they have also taken all precautionary measures including the approval from the Archaeological Department.

7.Hence the petitioner need not be panic about any environmental hindrance. At the same time, it is also obligatory on the part of the respondents to put up the construction by taking necessary precautionary measures while putting up the construction."
