ORDER
The petitioner seeks issuance of writ of mandamus to direct the first respondent to consider the petitioner's representation dated 07.07.2025. In view of the limited prayer sought for in the writ petition, with the consent of the counsel on either side, the writ petitioner is taken up for final disposal.
2.The case of the petitioner is that the petitioner is a partner of Murali Oil Mills, which was established way back in the year 1969 originally by four partners and thereafter, with passage of time, there has been reconstitution of the firm in 2007, 2019 and lastly in 2023. 3.According to the petitioner, one of the partners executed a registered Will bequeathing her entire interest in the said Mills to the petitioner and after her death, the partnership was reconstituted in June, 2023 between the petitioner and his wife. According to the petitioner, the petitioner has been operating the Mill with all valid licenses and 2/5
registration. However, the erstwhile partner who retired in the year 2019 has suppressed the material circumstances and proceeded to enter into a rental agreement with the second responent on 10.06.2024. Seeking cancellation of the said rental agreement and to recognize the petitioner and his wife as the lawful tenants under the second respondent, the petitioner has given a representation on 07.07.2025. 4.The grievance of the petitioner is that despite passage of four months, there is no action taken on the representation given by the writ petitioner.
5. Mr.Avinash Wadhwani takes notice for the respondent Nos. 1 &
2. He would submit that the petitioner's representation would be actively considered and disposed of within a period of 12 weeks from the date of receipt of a copy of this order.
6.In the light of the above, the writ petition is disposed of with the direction to the first respondent to consider the petitioner's representation dated 07.07.2025 on merits and in accordance with law and pass orders on 3/5
the same, within a period of 12 weeks, from the date of receipt of a copy of this order. No costs.
