The challenge in this Writ Petition is to Notification No.1 to 60 dated 01.12.2023, specifically Serial No.55 of that Notification.

Mr.Pradeep Raja, who accepts notice on behalf of the Executive Engineer and Administrative Officer, Vellore Housing Scheme, Tamil Nadu Housing Board, arrayed as sole respondent, would state that the impugned notification has itself been withdrawn. He has filed a memo dated 22.12.2023 to this effect, which reads as follows:

1. It is submitted that the 1st respondent / Vellore Housing Unit, Tamil Nadu Housing Board published E-Tendering and EAuction notification No.01 to 60 dated 01.12.2023 in Daily Thanthi (Tamil) Newspaper Publication dated 03.12.2023 and the Hindu (English) News Paper dated 03.12.2023 inviting applications. The said notification dated 01.12.2023 was challenged in the Writ Petition in W.P.No.35911 of 2023 before this Hon'ble High Court.

Further, it is submitted that on instruction of the respondent that the said E-Tendering and E-Auction notification No.01 to 60, dated 01.12.2023 was cancelled due to administrative reasons and the same was published in the Daily Thanthi (Tamil) News Paper dated 15.12.2023, the same is enclosed with this memo and it may be accepted in the interest of Justice. It is therefore prayed that this Hon'ble Court may be pleased to accept the memo filed by the respondent and dismiss the WP.No.35911 of 2023 and thus render Justice.

3. In such circumstances, the cause of action in this Writ Petition does not survive any further.

4. Recording the aforesaid, this Writ Petition is dismissed as infructuous. No costs.
