ORDER

This petition is filed to modify the condition no.7[c] imposed on the petitioner in bail order dated 11.06.2024 in Crl.O.P.No.12810 of 2024 and direct the learned NDPS Court, Chennai to return the Passport (Z7573998) of the petitioner.

2. The learned counsel for the petitioner submitted that the petitioner is a professional scuba diver and for establishing the facility at Pondicherry he has to visit Thailand regularly. Hence, for that purpose the passport is also required. 1/2 https://www.mhc.tn.gov.in/judis

rna Hence, he has come forward with the present modification petition to modify the condition no.7[c] in Crl.O.P.No.12810 of 2024 dated 11.06.2024.

3. Admittedly, the petitioner involved in NDPS offence he is in interim bail. The trial of the stage is pending for framing of charges. Though it is stated that he needs to go to Thailand, no convincing reason placed before me, indicating his visit is indispensable for establishing scuba facility at Pondicherry and further it has not substantiated by any documentary proof that he is involved in such activities and same is his livelihood.

4. Considering the fact that the petitioner involved in NDPS offence and already charge is framed. I am of the view that directions the trial Court to complete the trial as early as possible would be appropriate instead of permitting the petitioner to leave the country.

5. With the above direction, this Criminal Miscellaneous Petition stands dismissed with direction, that the trial Court is directed to dispose of the trial expeditiously as early as possible.
