The applicant has already initiated arbitral proceedings before the learned Arbitrator as early as 07.11.2022.

2. The learned Arbitrator is yet to pass a Final Award, though has entered upon reference.

3. Therefore, this application under Section 9 of the Arbitration and Conciliation Act, 1996 is not maintainable.

4. The applicant can move appropriate application under Section 17 of the Arbitration and Conciliation Act, 1996 before the learned Arbitrator for interim relief.

5. With the above liberty, this Arbitration Application stands dismissed.
