Petition filed under Article 226 of the Constitution of India, praying to issue Writ of Habeas Corpus, to call for the entire records connected with the order of the 2nd respondent herein in CPT No.70/2023 dated 17.11.2023 passed against the petitioner's son the detenu namely Sundharamoorthy @ Paammarli, son of Ramesh, aged about 20 years as a 'GOONDA' who is confined at Central Prison, Puzhal, Chennai and set aside the same, consequently directing the respondents herein to produce the body and person of the detenu before this Hon'ble Court and set him at liberty. The petitioner, mother of the detenu, namely Sundharamoorthy @ Paammarli, aged 20 years, S/o. Ramesh, has come forward with this petition challenging the detention order passed by the 2nd respondent dated 17.11.2023 slapped on her son, branding him as "Goonda" as contemplated under Section 2(f) of the Tamil Nadu Act 14 of 1982. 2/5
2.The learned Additional Public Prosecutor would submit that the order of detention passed by the second respondent as against the son of the petitioner herein dated 17.11.2023 has been revoked by the Government in G.O. [Rt] No.7144, Home, Prohibition & Excise (XI) Department, dated 21.12.2023 and he has also produced a copy of the said order. 3.Recording the submission of the learned Additional Public Prosecutor, this petition is dismissed as the same has become infructuous.
