The transfer petition is filed to withdraw and transfer OP.No.284 of 2024 pending before the Family Court, Sivagangai to III Additional Principal Judge, Family Court, Chennai to take up along with MC.No.606 of 2024 pending before the III Additional Principal Judge, Family Court, Chennai.
2. The counsel for the petitioner has served the learned counsel for the respondent appearing in the Trial Court and has also filed a memo on the file of the Family Court informing the Court as well as the respondent about the filing of the transfer petitioner and the fact that notice has been issued. Therefore, the respondent has been sufficiently put on notice about the petition and has chosen not to appear.
3. The petitioner married the respondent on 30.10.2020 and due to difference of opinion the parties separated and the respondent has filed HMOP.No.284 of 2024, on the file of the Family Court, Sivagangai seeking restitution of conjugal rights. 2/5
4. The petitioner would submit that she is residing at Chennai with her 3 year old minor daughter and presently working in HDFC Bank, Vepery Branch. The petitioner would submit that she has filed MC.No.606 of 2024, on the file of the III Additional Judge, Family Court, Chennai, seeking maintenance. The petitioner would submit that it is very difficult for her to travel from Chennai to Sivagangai to attend every hearing.
5. Considering the fact that the petitioner is residing and working at Chennai, and also the fact that the maintenance case filed by the petitioner is pending on the file of the III Additional Judge, Family Court, Chennai, the transfer petition is allowed as prayed for. Consequently, the connected miscellaneous petition is closed. No costs.
