Prayer : Writ Petition filed under Article 226 of Constitution of India praying for issuance of Writ of Mandamus, directing the respondents 1 to 5 to consider the petitioner's representation dated 08.08.2025, 11.08.2025, 18.08.2025 and 10.09.2025 and dispose of the same within a stipulated time.

ORDER

This Writ Petition has been filed seeking a direction to the respondents 1 to 5 to consider the representations submitted by the petitioner, seeking enquiry on the objections raised by her with regard to laying of the road.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner owned land comprised in Survey Nos. 545/2, 545/3, 546/3A and 548/4, situated at Chithoor Village,

Santhavellore Village Limit, Sriperumbudur Taluk, Kanchipuram District. The petitioner was also issued patta for the said land under Patta Nos.635 and 213. While being so, there exists a pathway named "Vandipathai" to an extent about 10 feet on both northern and southern sides of her property. In that context, the sixth respondent measured the property and attempted to lay a road.

It is further seen that the petitioner has already filed a suit in O.S.No.130 of 2024 on the file of the District Munsif Court, Sriperumbudur, seeking a decree of permanent injunction and the same is pending without any interim order. Pending suit, the petitioner submitted representations raising objections to the laying of the road.

5. On instructions, the learned Special Government Pleader submitted that, as per the revenue records, the land is classified as car track and as such, the respondents measured the land for laying the road. Therefore, the petitioner cannot obstruct the officials from carrying out to lay the road. Even assuming that the said portion of the land is falls within the patta land, once the revenue records disclose that the land is "Vandipathai", no pattadar can raise any objection to the laying of the

road.

6. In view of the above, the representation submitted by the petitioner cannot be considered. Thus, the writ petition is devoid of merits and is liable to be dismissed. Accordingly, this Writ Petition stands dismissed. Consequently, connected miscellaneous petition is closed. No costs.
