Prayer:

Plaint under Order VI, Rule 1 of O.S. Read with Order VII Rule of CPC ., prays to pass a decree, a) directing partition of the property described in the schedule by metes and bounds and allot 2/6th share thereon to the two plaintiffs in respect of the land together with the first and second floor of the suit schedule property;

b) for a sum of Rs.1,00,000/- as the share of mesne profits realized from the suit property against the defendants 1 and 2 and for future mesne profits from the date of suit till the date of delivery of possession of the plaintiff's share and c) directing the defendants to pay the costs of the suit. For Plaintiffs : Mr.T.S.Baskaran for M/s.G. Sakthivel For Defendants : Mr.G.R. Lakshmi for D1, 2 and 6 to 8 JUDGEMENT When this matter is taken up for hearing, the learned counsel appearing for the plaintiffs, seeks permission of this court to withdraw the suit. He has also filed a memo to that effect. 2/4

2. Recording the abovesaid memo, this Suit is dismissed as withdrawn. No costs.
